Information on the collection of personal data: 

In the following we inform about the collection of personal data when using our product Color Equalizer. Personal data is all data that can be personally related to you. 

Responsible in accordance with Art. 4 sec. 7 of the EU General Data Protection Regulation (GDPR) is ColorGATE Digital Output Solutions GmbH, Große Düwelstraße 1, 30171 Hannover, contact@remove-this.colorgate.com.  

Type and scope of data collection: 

When you enter into a software license agreement with us, with which we grant you certain rights of use for the respective software, we collect the following information: name and contact details as well as information, necessary for the granting the rights of use. 

The collection of data is carried out in order to be able to identify you as our customer, to be able to make the software available to you for use, for correspondence with you, for the settlement of license fees, as well as for the processing of any liability or other claims against us and the assertion of any claims against you. 

The data processing is carried out at your request and is necessary for the aforementioned purposes for the mutual fulfilment of obligations under the license agreement. The legal basis for the processing of personal data is the execution of the contract within the meaning of Article 6 (1) lit.b) GDPR; in addition, data processing may be carried out on the basis of our legitimate interests within the meaning of Art. 6 sec. 1 lit. f. GDPR. Insofar as data processing is not already required for contract processing, we store and use your data to effectively perform our tasks and optimize our services. 

In any case, the personal data will be kept until the termination of the contract and the expiry of all time limits for asserting contractual claims. Thereafter, the storage takes place in compliance with the existing retention and documentation periods, which may arise in particular from commercial or tax law. A longer storage can also take place if you have consented to it. 

Your personal data will not be transferred to third parties for purposes other than those listed below, in particular not for advertising purposes. Insofar as it is necessary to provide you with the software, your personal data will be passed on to third parties, in particular ColorLogic GmbH, Landersumer Weg 40, 48431 Rheine, Germany.  

Automated decision-making based on your personal data and the transfer of personal data to third countries outside the European Union will not take place. 

Your rights 

You have the following rights with regard to your personal data: 

  • Right to demand information, 
  • Right to rectification or erasure, 
  • Right to restrict processing, 
  • Right to object the processing, 
  • Right to data portability. 

You also have the right to complain to a data protection supervisory authority about our processing of your personal data. 

 

A consent given by you can be revoked free at any time with effect for the future. The revocation of consent does not affect the legality of the processing carried out on the basis of the consent until the revocation. If the processing of your personal data is not based on consent, but is based on a different legal basis, you can object to this data processing. Their opposition will result in a review and, if necessary, termination of the data processing. You will be informed about the results of the verification and will receive further information from us as to why the data processing is permitted.
